Terms of Service

By accessing or using Burrn's services, website, or mobile applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services. These Terms constitute a legally binding agreement between you and Burrn Technologies Inc. ("Burrn," "we," "us," or "our"). Please read them carefully.

Burrn provides: • eSIM Services: Digital SIM cards that provide mobile data connectivity in multiple countries without requiring a physical SIM card. • Virtual Phone Numbers: Internet-based phone numbers that allow you to make and receive calls and SMS messages over the internet (VoIP). • Wallet Services: A digital wallet system for purchasing and managing credits used for our services. Our Services are designed for personal and lawful business use. Commercial resale or redistribution of our Services is prohibited without written authorization.

To use our Services, you must: • Be at least 18 years of age or the age of majority in your jurisdiction • Provide accurate, current, and complete information during registration • Maintain and promptly update your account information • Maintain the security of your account credentials • Accept responsibility for all activities that occur under your account You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

Pricing: All prices are displayed in US Dollars unless otherwise specified. Prices are subject to change with notice. Payment Methods: We accept major credit cards, debit cards, Apple Pay, and Google Pay through our secure payment processor. Wallet Credits: Credits added to your wallet are non-refundable and non-transferable. Credits do not expire. Automatic Renewal: Phone number subscriptions are automatically renewed monthly. You authorize us to charge your wallet balance for these recurring charges. Failed Payments: If a payment fails, we may suspend your services until payment is received. Phone numbers may be released if the monthly fee cannot be collected. Taxes: You are responsible for any applicable taxes on your purchases.

Activation: eSIM plans are activated upon first connection to a network in a supported country. Validity periods begin at activation, not purchase. Device Compatibility: You are responsible for ensuring your device supports eSIM. We are not responsible if your device is incompatible. Fair Usage: Our data plans are intended for normal personal use including browsing, streaming, video calls, and messaging. Prohibited uses include: - Running servers or peer-to-peer file sharing - Using data for commercial purposes without authorization - Tethering/hotspot use if not explicitly included in your plan - Any illegal activities Network Coverage: Coverage and speeds depend on local network conditions and are not guaranteed. We partner with local carriers in each country. Plan Expiration: Unused data does not roll over when a plan expires.

Number Allocation: Phone numbers are assigned based on availability. We do not guarantee specific numbers. Permitted Use: Virtual phone numbers may only be used for lawful purposes. Prohibited uses include: - Spam, fraud, or harassment - Telemarketing without proper consent - Impersonation or spoofing - Any illegal activities Emergency Services: Virtual phone numbers DO NOT support 911 or other emergency services. Do not rely on our Services for emergency calls. Number Portability: We currently do not support porting numbers to or from other carriers. Number Release: Numbers may be released and reassigned if: - Your account is terminated - Monthly fees are not paid - The number is not used for 90 consecutive days - You cancel your subscription

You agree not to: • Violate any laws, regulations, or third-party rights • Use Services for fraudulent, illegal, or harmful purposes • Transmit viruses, malware, or other harmful code • Attempt to gain unauthorized access to our systems • Interfere with or disrupt our Services • Reverse engineer or decompile our software • Use our Services to violate telecommunications regulations • Resell or redistribute our Services without authorization • Use automated systems to access our Services • Engage in any activity that could damage our reputation We reserve the right to suspend or terminate Services for violations of these prohibitions.

Our Property: The Burrn name, logo, website, applications, and all related content are owned by Burrn Technologies Inc. and protected by intellectual property laws. License: We grant you a limited, non-exclusive, non-transferable license to use our Services for personal, non-commercial purposes in accordance with these Terms. Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Services without our written consent. User Content: You retain ownership of content you transmit through our Services. By using our Services, you grant us a license to process your content as necessary to provide the Services.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING: • MERCHANTABILITY • FITNESS FOR A PARTICULAR PURPOSE • NON-INFRINGEMENT • UNINTERRUPTED OR ERROR-FREE SERVICE • ACCURACY OR RELIABILITY OF CONTENT WE DO NOT GUARANTEE THAT SERVICES WILL BE AVAILABLE IN ALL LOCATIONS OR AT ALL TIMES. NETWORK COVERAGE, SPEEDS, AND QUALITY MAY VARY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: • BURRN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM • WE ARE NOT LIABLE FOR DAMAGES ARISING FROM: - Service interruptions or outages - Loss of data or unauthorized access to your data - Actions of third-party partners or carriers - Your use or inability to use our Services Some jurisdictions do not allow limitations of liability, so these limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Burrn and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: • Your use of our Services • Your violation of these Terms • Your violation of any third-party rights • Your violation of any laws or regulations

By You: You may cancel your account at any time through your account settings or by contacting support. By Us: We may suspend or terminate your access to Services at any time for: • Violation of these Terms • Non-payment • Fraudulent or illegal activity • Extended periods of inactivity • At our discretion with reasonable notice Effects of Termination: Upon termination: • Your access to Services will cease • Phone numbers will be released • Unused wallet credits will be forfeited (except where prohibited by law) • Provisions that by their nature should survive will remain in effect

Governing Law: These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Dispute Resolution: Any disputes arising from these Terms or our Services shall be resolved through binding arbitration in San Francisco, California, except for disputes that qualify for small claims court. Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration. Statute of Limitations: Any claim must be brought within one year of the date the cause of action arose.

We may modify these Terms at any time. We will provide notice of material changes by: • Posting the updated Terms on our website • Updating the "Last Updated" date • Sending you an email notification Your continued use of our Services after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using our Services.

Entire Agreement: These Terms constitute the entire agreement between you and Burrn regarding the Services. Severability: If any provision is found unenforceable, the remaining provisions will continue in effect. Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision. Assignment: You may not assign these Terms. We may assign these Terms to any affiliate or successor in interest. Notices: We may send notices to the email address associated with your account. You are responsible for keeping your contact information current.
